  • Utkrishtha Law Offices Secures Arbitral Award of Approximately ₹106 Crore for HCIL-Adhikarya-ARSS

Utkrishtha Law Offices successfully represented HCIL-Adhikarya-ARSS (JV) in arbitration proceedings against Rail Vikas Nigam Limited (RVNL), culminating in an arbitral award of approximately ₹106 crore in favour of the Firm’s client.

The dispute arose out of the execution of a major railway infrastructure and overhead electrification project and involved substantial claims arising from prolongation of the works, delayed/non-availability of hindrance-free work fronts, extension of the contractual completion period, idling and under-utilisation of resources, and the consequential financial impact upon the contractor.

The arbitration involved examination of extensive contemporaneous project correspondence, contractual provisions, extension-of-time records, site-related hindrances and the financial consequences arising from prolonged execution of the project. The Arbitral Tribunal ultimately allowed substantial claims raised on behalf of the contractor.

The Firm’s team comprised Adv. Shubham Jain, Partner; Adv. Jaywardhan Lunawat, Legal Associate; and Adv. Kartikay Bhaskar, Legal Associate, who worked extensively on the arbitration.

The award reflects the Firm’s expertise in complex construction and infrastructure arbitration, particularly disputes involving delay and prolongation claims, contractual interpretation, extension of time, disruption, idling of resources and compensation arising from large public infrastructure projects.
